These Beta Terms apply only to a feature expressly identified as beta, preview, or experimental that the Customer elects to access. They supplement the Customer Agreement with Software Programming Group LLC. A generally available feature is not a Beta Service merely because it is recently released.
1. Evaluation scope
The Provider may identify the evaluation period, usage limits, participating users, permitted data, and any charges in the beta invitation. Access is for the stated evaluation purpose. The Provider may modify, restrict, or discontinue the Beta Service and is not obligated to release a production version or provide migration compatibility. Beta access does not authorize the Customer to access unrelated unreleased functions.
2. Data and safeguards
The Customer should use test or deidentified information wherever feasible and must not use regulated, confidential, or production-critical data unless the Provider expressly permits that data in writing and appropriate safeguards and agreements apply. If the Provider processes Customer Personal Data through an authorized beta, the DPA and mandatory privacy obligations continue to apply. The beta label does not waive security or data-subject rights.
The Customer must maintain independent copies of important data and refrain from relying on a beta for emergencies, legal deadlines, or operational continuity. Feedback and bug reports must not unnecessarily contain credentials or third-party personal information.
3. Support and changes
Beta support is limited to the support described in the invitation. No service credit, uptime target, resolution time, or continuing feature availability applies unless expressly agreed. The Provider will communicate known discontinuation and data-retrieval arrangements when practicable, and will process personal data on exit under the DPA.
4. Confidentiality and feedback
Nonpublic beta documentation and access details designated confidential remain Confidential Information. The Customer must not disclose them outside authorized evaluators without consent. Voluntary feedback may be used under the feedback provision of the Customer Terms; no broader rights in Customer Data are granted.
5. Warranties and liability
To the maximum extent permitted by law, Beta Services are supplied as is and as available, without a warranty that they will meet production requirements or remain unchanged. The Customer Agreement’s liability provisions and mandatory-law exceptions apply. These Terms do not reduce liability for fraud, willful misconduct, or obligations that cannot lawfully be excluded.
6. Ending participation
Either party may end the beta evaluation through the notice method in the invitation or support@calendnow.ai. Ending a beta does not cancel an independent paid subscription unless expressly stated. Charges for a paid beta, if any, require an accepted Order identifying them before billing begins.
